You often hear that the constitution provides for “Separation of Church and State”. This was an interpretation made by Thomas Jefferson in a letter to the Marbury Baptist Church, but was not actually a constitutional position. The constitution says “Congress shall make no law regarding the establishment of religion, nor prohibiting free exercise thereof”.

This wording suggests that Congress was not supposed to make a law establishing a federal religion that all Americans would be bound to follow, and also that it would allow any American to follow their faith, even when on government property or in a role as a government servant.
